Rule
The mail fraud statute requires that use of the mails be “for the purpose of executing” the scheme; mailings that occur after the defendant has obtained money or property and are not intended to advance the scheme are not covered — the mailing must be an integral part of the fraudulent scheme.
Significance
Limits the scope of mail fraud; a defendant who fraudulently obtained money and whose subsequent mailing by third parties was incidental to the already-completed scheme cannot be convicted under the mail fraud statute.
