Rule

The residual clause of 18 U.S.C. § 924(c)(3)(B), defining “crime of violence” as a felony that “by its nature, involves a substantial risk that physical force against the person or property of another may be used,” is unconstitutionally vague.

Significance

Struck down the § 924(c) residual clause as void for vagueness consistent with the Supreme Court’s vagueness doctrine in Johnson v. United States (2015) and Sessions v. Dimaya (2018), invalidating convictions resting solely on the residual clause.
