Rule
Hearsay evidence is admissible under the Confrontation Clause if the declarant is unavailable and the statement bears adequate “indicia of reliability” (either falls within a firmly rooted hearsay exception or shows particularized guarantees of trustworthiness). Overruled by Crawford v. Washington.
Significance
Pre-Crawford reliability-based Confrontation Clause standard; overruled by Crawford v. Washington (2004) which replaced it with a testimonial/non-testimonial analysis.
