Rule
A defendant acquitted by reason of insanity may be committed to a mental institution without additional procedural safeguards (such as a civil commitment hearing); the insanity acquittal itself establishes both that the person committed the act and that they suffered from a mental disorder at the time.
Significance
An insanity acquittee’s commitment does not require the same procedures as civil commitment; commitment may continue beyond the maximum sentence for the offense if the person remains dangerous and mentally ill.
